To obtain a divorce or dissolve a civil partnership, you must prove that the marriage or civil partnership has ‘irretrievably broken down’. In order to prove this, you must satisfy the Court that one of the following 5 facts applies:
- Adultery and intolerability;
- That your partner has behaved in such a way that you can no longer be expected to live with them;
- That your partner has deserted you for a continuous period of 2 years;
- 2 years separation and consent; and
- 5 years separation.
